course aims in Estonian
Eesmärk on anda üliõpilastele ülevaade intellektuaalse omandi õiguskaitse arengust ning kaitseobjektidest. Eesmärk on selgitada intellektuaalse omandi õiguse olemust kunsti-, kirjandus-, muusikateoste ja arvutitarkvara autoriõiguse valdkonnas kui ka tööstusomandi objektide leiutised, kaubamärgid, tööstusdisainilahendused jms valdkonnas.

Eesmärgiks on käsitleda autoriõiguse ning tööstusomandiobjektide õiguskaitse küsimusi nii Eestis kui välismaal ja selle valdkonna tähtsamate rahvusvaheliste organisatsioonide ning kokkulepete (WIPO, Pariisi ja Berni konventsioonid, Euroopa Patendikonventsioon (EPC), Patendikoostööleping (PCT), TRIPS leping jmt) olemust ja põhisätteid.

Objective of the course is to give students overview of the development of the protection of intellectual property and the objects subject to protection. The aim is to explain the essence of intellectual property in the field of copyright – artistic, literary, musical compositions and computer programs and also in the field of industrial property objects – inventions, trademarks, industrial designs etc.

The aim is to discuss matters of legal protection of copyright and industrial property in Estonia and abroad and the essence and main principles of most important organizations and treaties in this field (WIPO, Paris and Bern Conventions, European Patent Convention (EPC), Patent Cooperation Treaty (PCT), TRIPS Agreement et al).

Õppeaine edukalt läbinud üliõpilane:
- saab ülevaate autoriõiguse ja tööstusomandiobjektide õiguskaitsest nii Eestis kui ka välismaal;
- tunneb Eesti autoriõiguse seaduse, patendi-, kasuliku mudeli, kaubamärgi- ja tööstusdisaini kaitse seaduse põhisätteid ning oskab neid rakendada kaasuste lahendamisel;
- saab ülevaate intellektuaalse omandi rahvusvahelistest konventsioonidest ja kokkulepetest, millega on ühinenud Eesti Vabariik.

After successfully passing the subject course the student:
- acquires an overview of legal protection of copyright and industrial property objects both in Estonia and abroad;
- is familiar with the main principles of Estonia’s copyright, patent, utility model, trademark and industrial design protection acts and knows how to use the same in the resolving of practical cases;
- acquires an overview of international conventions and agreements on intellectual property to which Estonia is joined.

Sisuks on nii autoriõiguse kui ka tööstusomandi õiguskaitse olemuse ning aluste (vastavate rahvusvaheliste konventsioonide ja Eesti seaduste) õpetamine üliõpilastele, kes peavad oskama orienteeruda omandanud valdkonna keerukas problemaatikas ning saama ülevaate sellest, kuidas rakendada praktikas autoriõiguse seadust üliõpilastööde koostamisel ning käsitletakse ka rahvusvahelisi konventsioone ja organisatsioone nagu Pariisi tööstusomandi kaitse konventsioon, Berni autorikaitse konventsioon, PCT, WIPO, EPO, jt. Käsitletakse ka piraatluse ja võltskaubanduse vastase võitluse küsimusi.
brief description of the course in English
The essence of the subject course is to provide students the knowledge of the essence and basics (respective international conventions and Estonian legislation) of legal protection of both copyright and industrial property. Students must be capable of navigating in the complex problematics of the subject matter and to get an overview how to implement in practice copyright law in compiling student papers. Also international conventions and organizations will be discussed, such as Paris Convention for the Protection of Industrial Property, Bern Convention for the Protection of Literary and Artistic Works, PCT, WIPO, EPO etc. Also matters of fighting against piracy and counterfeiting will be discussed.
